  1. Communication regarding the event (e.g., changes, cancellations, or updates).
  2. Security and safety of event attendees.
  3. Compliance with national, local, and regulatory requirements, including but not limited to safety and noise compliance during the event.

Refund Policy: eShopper Africa Users must contact the event hosts directly for any issues related to refunds or cancellations .

9. Force Majeure Disclaimer


eShopper Africa shall not be held liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, strikes, pandemics, or technical failures. These events constitute a force majeure, and we reserve the right to suspend or terminate services without liability in such cases.

10. Litigation and Liability Disclaimer


By using the Platform or Mobile App, you agree that eShopper Africa is not liable for any disputes, claims, or litigation arising from ticket sales for events hosted by third parties. The event hosts are solely responsible for:

  1. The organization, execution, and management of their events.
  2. Compliance with all applicable laws, regulations, and permits.
  3. Addressing and resolving attendee complaints, claims, or disputes related to the event.

eShopper Africa acts only as a facilitator for ticket sales and shall not be held accountable for issues beyond our control, including but not limited to event cancellations, postponements, or breaches of contract by event hosts.

11. User Responsibilities and Compliance


By using the Platform or Mobile App, you agree to comply with all data protection rights and privileges as stated in the Kenyan Constitution of 2010. You further agree:

  1. Not to engage in actions that bypass existing security provisions, hack, decompile, or attempt to extract unauthorised information from the Platform or Mobile App.
  2. To report and share any security vulnerabilities or breaches you may come across while using the Platform or Mobile App.

Failure to comply with these responsibilities may result in account suspension or legal action where applicable. Additionally:

  • Failure to report discovered security vulnerabilities or breaches will lead to the cancellation of all contracts entered into between eShopper Africa and the offending party.
  • If it is established that the offending party attempted or succeeded in hacking the Platform or Mobile App, eShopper Africa reserves the right to take legal action. Any costs or charges arising from such actions will be fully borne by the offending party.

12. Ticket Transfer and Resale Prohibition


The transfer and/or resale of tickets purchased on our Platform or Mobile App is strictly prohibited. If such activity is detected, eShopper Africa reserves the right to cancel the tickets without notice.
